Narrative
The driver of the subject MY2019 E450 4MATIC cabriolet initially contacted the MBUSA Customer Assistance Center ("CAC") on May 7, 2024 and alleged he was driving northbound on [XXX] in Westport, Connecticut on April [XXX], 2024 in the left lane at approximately 55 miles per hour when "suddenly and without warning the car veered to the left". The driver alleged a complete loss of steering and that he was "unable to turn the wheel" and the vehicle struck a concrete center divider. The driver alleged he brought the vehicle to a stop in the median. When the driver first contacted the CAC, he did not state that any ADAS systems were engaged at the time of the alleged incident. Those initial allegations did not trigger a reporting requirement under NHTSA ADAS SGO.
On June 5, 2024, EDR data was imaged from the subject vehicle. The EDR data references an unbelted driver with no passengers, and the vehicle speed at 72 mph immediately prior to the alleged collision with the concrete divider. MBUSA requested additional information from the owner to continue its investigation into the allegations. On June 7, 2024, the driver alleged for the first time that "I think that both adaptive cruise and driver assist/lane departure were both active". At the time of the alleged incident, a tow was dispatched by MBUSA Roadside Assistance at the request of the driver. There are currently no allegations of injury or airbag deployment by the driver.
The new allegation of ADAS engagement prior to the alleged incident, in combination with the towing of the vehicle triggered the 5-Day reporting requirement of the NHTSA ADAS SGO. Accordingly, MBUSA is submitting this 5-day incident report and is continuing its investigation of the incident.
