Narrative
The customer is not alleging any defect with the vehicle. The customer was directed by a retailer to contact Subaru with a request for Goodwill Loyalty Purchase Assistance to be used toward the purchase of a new Subaru vehicle.
According to the customer's statement, the subject vehicle was proceeding at 45 MPH in Cedar Park, TX when another vehicle pulled out in front of the subject vehicle and the customer did not have enough time to react to avoid the collision. The customer's response to an incident questionnaire indicates that Adaptive Cruise Control (ACC) and Lane Centering (LC) were engaged at the time of the incident. The customer further stated the Automatic Emergency Brake (AEB) did engage to reduce the speed at the time of impact. As a result of the collision, no airbags deployed and subject vehicle was towed from the location of the incident.
A police report confirms the location of the accident on northeast bound lanes of [XXX] in Cedar Park Texas at 3:47 PM on [XXX]. The report indicates that the driver of the other vehicle failed to yield the right of way while leaving a private driveway (parking lot exit).
