Narrative

The information contained in this report is based on Nissan's notification via telematics that a vehicle equipped with Pro Pilot Assist 2.0 was involved in an incident involving an air bag deployment, as well as Nissan's understanding of the allegations received during Claimant's discussions with Nissan's Consumer Affairs representatives on 4/24/2024. The system was active within 30 seconds of the incident. The deployment took place on [XXX] between [XXX] and [XXX]. Nissan is currently examining its ability to provide additional details that may be protected by consumer privacy laws. On 4/24/2024, the Claimant orally stated that the vehicle did not stop when the customer pressed the brake. The Claimant also stated that the "self-driving" mode did not stop the vehicle. The vehicle was towed to a Nissan dealership. Nissan is gathering additional information and will supplement with the monthly report On 5/2/2024, Claimant stated vehicle was in "auto pilot" drive in stop and go traffic. Claimant stated traffic slowed down and the vehicle in front stopped and Claimant's vehicle did not slow down. Claimant stated the screen blinked red. Claimant stated Claimant stepped on brake as far down as possible and vehicle would not stop. Claimant was going maybe 50 mph and had a collision with the vehicle in front. ProPilot 2.0 and ProPilot 1.0 were active within 30 seconds prior to the incident. A police report was filed by the MA State Police. It is unclear if there is an active law enforcement investigation for this incident. The vehicle inspection is scheduled for 5/15/2024. Nissan will submit an updated report pending the inspection completion. 6/14/2023 Update: The vehicle inspection revealed pedal misapplication to be the cause of the incident. The vehicle 'AEB alert' appeared in the instrument panel. The customer reacted by applying 100% throttle which canceled the AEB function and allowed the customer to maintain responsibility of the vehicle function. The customer switched to the brake one half of a second prior to time zero but was unable to stop the vehicle prior to the impact.
