Rivian R1S Incident

On October [XXX], 2023, at 5 p.m. PST, the subject vehicle was being operated at low speeds in stop and go traffic, on a highway with Rivians Level 2 ADAS feature Highway Assist (HWA) engaged. According to the driver, a vehicle to the right of the subject vehicle attempted to merge in front of the subject vehicle, underestimating the distance needed to complete the merger and the other vehicle crashed into the subject vehicle. The crash resulted in minor damage to the subject vehicle. The state of the other vehicle is unknown but believed to also have minor damage. Data indicates that the driver of the subject vehicle did not have hands on the wheel for approximately 45 seconds before the crash or at the time of impact. Data indicates that the vehicle did not malfunction and performed as designed in response to driver inputs.
